Tribal Leader Notice – BIA, DOI: Energy and Mineral Development Program Grants: Collection of information re: TERAs

On January 24, 2023, the Bureau of Indian Affairs (“BIA”) issued a notice soliciting written comments and recommendations for a proposed information collection request (“ICR”) concerning Tribal Energy Resource Agreements.
BIA is especially interested in public comment addressing the following:
Whether or not the collection of information is necessary for the proper performance of the functions of the agency, including whether or not the information will have practical utility;
The accuracy of our estimate of the burden for this collection of information, including the validity of the methodology and assumptions used;
Ways to enhance the quality, utility, and clarity of the information to be collected; and
How might the agency minimize the burden of the collection of information on those who are to respond, including through the use of appropriate automated, electronic, mechanical, or other technological collection techniques or other forms of information technology, e.g., permitting electronic submission of response.
Submission of this information is required for federally recognized Indian Tribes to apply for, implement, reassume, or rescind a Tribal Energy Resource Agreement (“TERA”) that has been entered into under 25 U.S.C. 3501 et seq., and 25 CFR 224. This collection also requires the Tribe to notify the public of certain actions and allows a petition from the public to be submitted to Interior to inform of possible noncompliance with a TERA.
